The apartment upstairs is supposed to be empty, but why do hear noise?

I always heard the person upstairs and now that person moved. I came to reconize the sound of somone up there or not. So after this person moved There was so much silence, and no creaks of any kind.So I know this in the day it is being remodeled and the managers give the key to the place like they trust anyone.They do not care about this place really.Anyway Now for 2 or 3 days I heard some creaks up there just now and last night I herad walking for sure.What on earth is going on here? Could they be lending it out illegaly or someone satying there? I know noone moved in yet because they just started remodeling and it takes some time.
